TERMS AND CONDITIONS
The Terms & Conditions included in this page outline the rules and regulations for creating an account by DREAMS CAN BLOOM to you THE CLIENT. By submitting this account creation form, you hereby certify you agree to the following Terms & Conditions prior to any purchases or sale agreements taking place:
(1) Prior to shipping, all invoices must be paid in full to our BANK ACCOUNTS including but not limited to shipping fees when applicable.
(2) The aforementioned promise of payment is made in acceptance of COD (Cash On Delivery) payment terms. DREAMS CAN BLOOM reserves the right to apply a moratory charge of 1.5% per month (18% per year) or the maximum allowed by law to all past due accounts.
(3) In the event your account is past due for a period any longer than 60 days, it will automatically be placed under COLLECTION status. The undersigned hereby agrees to pay all pending amounts belonging to any account placed under COLLECTION status, plus any collection costs, including but not limited to, attorney’s fees and wages and subsequently agrees that any action taken against DREAMS CAN BLOOM may be brought in the appropriate court. This agreement shall be enforced by the laws of the State of Florida.
(4) If the entity (THE CLIENT) signing this agreement is a Corporation or Partnership, the person submitting this agreement to DREAMS CAN BLOOM hereby certifies that he or she is an authorized signatory within the respective organization hereunder.
(5) Any claims or disputes must be informed via written notice to DREAMS CAN BLOOM and should abide by the below CREDIT AND CLAIM POLICY.
CREDIT AND CLAIM POLICY
Flowers are a natural, perishable, and delicate product and as such carry a latent risk of suffering damage at any stage of the supply chain. Should your shipment include flowers that are visibly damaged or that do not otherwise display the quality you expect from our product, please refer, and adhere to the following policies, guidelines, and procedures, as they will be strictly enforced by DREAMS CAN BLOOM.
(1) All products must be checked and inspected upon arrival.
(2). Please inform DREAMS CAN BLOOM in written notice through any of their representatives of any quality problems you observe, and think may lead to a credit request in the received products within 24 hours of product arrival. Your written notice must include all your order relevant information including order date, invoice number, number of unusable stems, bunches or units, carrier, and Airway Bill number.
(3) Please provide photographic evidence of the damaged products as well as the adhesive labels present in the boxes via e-mail for tracking and tracing purposes. Please keep all the product packages including but not limited to: Boxes, shipping labels, sleeves, stem labels and covers, as they will be required to process your credit request. Do not immediately discard or throw away any of the damaged products or its packaging, as DREAMS CAN BLOOM reserves the right to request inspection of the problem items before granting a credit.
(4) Any damages caused by transportation delays, storage issues or mishandling is responsibility of the airfreight agent or carrier of your choice. Please direct such claims to the respective carrier. DREAMS CAN BLOOM should not be liable for damages caused by third party agents.
(5) DREAMS CAN BLOOM will accept and process credits and disputes for the total amount corresponding to the value of the flowers ONLY, and NOT shipping or ANY OTHER COSTS.
The above Terms & Conditions shall constitute an agreement of sale. I hereby certify that I understand and accept all the above terms and conditions and that the information provided is true to the best of my knowledge. I hereby certify under penalty of perjury that the statements contained in the form I am signing correspond to reality and that my name and that of my organization matches the one included in this form. I understand that the information submitted will be used by DREAMS CAN BLOOM to determine my firm’s credit worthiness. I agree to my information being used by DREAMS CAN BLOOM and its subsidiaries for marketing purposes within their organization. I certify that I am signing this agreement as an officer, partner, agent, or owner and that I accept and will abide by the above terms of sale.
USE OF VOUCHER CODES
(1) 'Discount coupon codes' (also abbreviated as 'coupon codes') can only be used for purchases by email.
(2) Coupon codes can only be redeemed by email.
(3) Voucher codes may be redeemed against purchases for delivery only. Selected voucher codes may be restricted for use against specified products only.
(4) Voucher codes are restricted to one use per customer and should not be passed on to additional recipients.
(5) Voucher codes must be entered at the point of placing your order on the website using the relevant part of the order form.
(6) We are unable to apply a discount to orders already placed.
(7) Voucher codes cannot be used in conjunction with any other promotions.
(8) Only one voucher code may be used per order.
(9) Where the voucher code entitles you to a percentage discount, the discount will not be applied to the delivery charge (‘delivery’ includes additional delivery services, which are charged in conjunction with Delivery, for example ‘before 1pm delivery’ surcharge).
(10) Voucher codes may be withdrawn, or suspended without notice for any reason. We will advise after you complete the order process if we cannot accept the discount code you have entered.
(11) Selected voucher codes may be restricted for use against specified products – where possible, details of further restrictions will be communicated at the point where we promote the voucher code to you.
(12) Voucher codes may also be set by us to a maximum number of redemptions – if we are not able to accept the discount code you have entered for this reason we will advise you accordingly after you complete the order process and the discount will not be applied.
(13) Vouchers codes cannot be exchanged for a cash alternative.
(14) We are unable to accept Gift Vouchers by email.
(15) We cannot be held responsible for non-availability of the website which may prevent use of Voucher codes.
(16) Changes to these terms of use may be made at any time.
